1. Sponsor. This The Incomer “Spot the Incomer” Giveaway (the “Giveaway”) is sponsored and administered by Sumerian Pictures LLC, 434 Houston Street, Suite 230, Nashville, Tennessee 37203 (“Sponsor”).
2. Eligibility. The Giveaway is open only to natural persons, who at the time of entry: (1) are legal residents of one of the forty-eight (48) contiguous United States and the District of Columbia; (2) are physically located within the eligible geographic area when entering; and (3) who are at least eighteen (18) years old at the time of entry. Employees, officers, directors, members, managers, and representatives of Sponsor or its parents, subsidiaries, affiliates, advertising and promotion agencies, and prize suppliers, and members of each such person’s immediate family or household, are not eligible to enter or win. For the purpose of these Official Rules: “Immediate family” means a spouse, parent, child, sibling, and the spouse of any such person, regardless of where they reside. “Household member” means any individual who shares the same residence for at least three (3) months during the twelve (12) months preceding the beginning of the Entry Period, whether related or not. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Eligibility is subject to verification by Sponsor. Void outside the eligible geographic area and wherever prohibited or restricted by law.
3. Entry Period. The Giveaway begins at 11:00 a.m. Eastern Time on October 6, 2026 and ends at 11:00 a.m. Eastern Time on October 13, 2026 (the “Entry Period”). The intended Entry Period is seven (7) calendar days. Sponsor’s computer systems are the official timekeeping devices for the Giveaway.
4. How to Enter. During the Entry Period, an eligible individual must: (1) visit https://sumerianpictures.com/movies/the-incomer; (2) complete the “Select all images with an Incomer” image challenge; (3) with the entrant’s first name, valid email address, and residential ZIP Code. Upon successful submission of the entry form, the entrant will receive one (1) entry into the Giveaway. Limit one (1) entry per person and per email address during the entire Entry Period. If more than one entry is received from the same person or email address, only the first eligible entry received may be considered, and all additional entries may be disqualified. An entrant may not use multiple identities, email addresses, accounts, devices, or other methods to obtain more than the permitted number of entries. Entries submitted through scripts, macros, bots, automated systems, artificial intelligence agents, or other automated means, or through any method that circumvents or interferes with the entry process, are void. All entries must be complete and received during the Entry Period. Proof that an entry was submitted does not constitute proof that Sponsor received it. Entries will not be acknowledged or returned. No purchase, payment, social media account, newsletter subscription, or marketing consent is required to enter or win. Any opportunity to subscribe to Sponsor’s newsletter must be presented separately and must be optional.
5. Prize. Sponsor will award one (1) prize to one (1) winner. The prize consists of two (2) admission tickets to a theatrical showing of The Incomer at a participating theater located reasonably near the winner’s residence, subject to theater participation, geographic availability, seat availability, available showtimes, and the continued theatrical exhibition of the film. The tickets may be provided electronically by email or made available for pickup at the applicable theater’s box office, as determined by Sponsor based on theater procedures and availability. The Approximate Retail Value (“ARV”) of the prize is $40. The tickets must be used together for a single eligible showing while The Incomer remains in theatrical release at the selected participating theater. The prize is valid only for standard-format admission and does not include premium-format, luxury-seating, or other upgrades or surcharges. Sponsor does not guarantee the availability of any particular theater, location, date, time, format, auditorium, or seat. If Sponsor determines that no participating theater is showing the film within a reasonable distance of the potential winner’s residential ZIP Code, the potential winner will be ineligible to receive the prize, and Sponsor may select an alternate potential winner. The prize does not include transportation, parking, lodging, meals, concessions, merchandise, upgrades, internet or mobile charges, or any other expense not expressly described in these Official Rules. All such expenses are the winner’s sole responsibility. The prize is non-transferable and may not be sold, assigned, substituted, or redeemed for cash. Sponsor may substitute the prize or a prize component with one of equal or greater retail value if the advertised prize becomes unavailable. Unused tickets will not be replaced or redeemed. The actual prize value may vary depending on the theater, location, showtime, and ticket price. The winner will not receive the difference between the stated ARV and the actual value of the prize. The winner is solely responsible for all federal, state, and local taxes, if any, and all other costs associated with accepting or using the prize.
6. Random Drawing and Odds. Approximately forty-eight (48) hours after the end of the Entry Period, Sponsor will conduct a random drawing from among all eligible entries received during the Entry Period to select one (1) potential winner. Sponsor will perform the drawing using a computerized random-selection method or another impartial random method determined by Sponsor. Sponsor will retain reasonable internal records identifying the entries included in the drawing, when the drawing occurred, the selection method used, and the result. Odds of winning depend on the total number of eligible entries received. The potential winner is subject to verification and is not the winner unless and until Sponsor confirms the potential winner’s eligibility and compliance with these Official Rules.
7. Winner Notification and Verification. Sponsor will attempt to notify each potential winner by email at the address provided with the entry within two (2) business days after the drawing. Each potential winner must respond to Sponsor’s notification within forty-eight (48) hours after the notification is sent and provide any information reasonably requested by Sponsor to verify eligibility and deliver the prize. Requested information may include the potential winner’s full legal name, residential address, date of birth, telephone number, and proof of age, identity, or residence. A potential winner may also be required to sign and return an affidavit or declaration of eligibility, liability release, publicity release where lawful, and any other documentation reasonably required by Sponsor. A potential winner may be disqualified and forfeit the prize if the potential winner: (a) does not respond within the required forty-eight-hour period; (b) cannot be contacted at the email address provided; (c) fails to provide requested verification or documentation by the deadline stated by Sponsor; (d) is not eligible; (e) has violated these Official Rules; (f) declines the prize; (g) provides false, incomplete, or misleading information; (h) cannot attend an eligible showing while the film remains in theaters; (i) does not have a participating theater showing the film within a reasonable distance of the potential winner’s residential ZIP Code; or (j) has a prize notification or prize returned as undeliverable. If a potential winner is disqualified or forfeits the prize, Sponsor may select an alternate potential winner by random drawing from the remaining eligible entries, time permitting. Sponsor may repeat this process until the prize is awarded or until Sponsor reasonably determines that the prize cannot be awarded. Sponsor is not responsible for a potential winner’s failure to receive or review an email because of spam filtering, security settings, an incorrect email address, a full inbox, or any other reason. Sponsor’s decisions concerning eligibility, winner verification, administration, and interpretation of these Official Rules are final and binding, subject to applicable law.
8. Publicity. Except where prohibited by law, acceptance of a prize constitutes the winner’s permission for Sponsor and its designees to use the winner’s first name, last initial, city and state of residence, statements concerning the Giveaway, voice, photograph, and likeness for advertising, publicity, and promotional purposes in any media now known or later developed, worldwide and in perpetuity, without further notice, approval, or compensation. Where legally required, Sponsor will obtain a separate written publicity release before making such use.
9. Entrant Representations and Conduct. By entering, each entrant represents and warrants that: (1) the entrant satisfies all eligibility requirements; (2) the information submitted is accurate and complete; (3) the entrant has complied with these Official Rules; and (4) participation does not violate any law or obligation applicable to the entrant. Entrants may not interfere with the Giveaway, the website, the image challenge, the entry process, or another entrant’s participation. Sponsor may disqualify any person Sponsor reasonably believes has: (a) tampered with or attempted to manipulate the entry process; (b) used automated or fraudulent entry methods; (c) submitted false information; (d) attempted to obtain more than the permitted number of entries; (e) interfered with the operation or security of the website; (f) acted in a disruptive, abusive, threatening, or unsportsmanlike manner; or (g) otherwise violated these Official Rules. Any attempt to deliberately damage a website or undermine the legitimate operation of the Giveaway may violate civil or criminal law. Sponsor reserves the right to seek damages and other remedies to the fullest extent permitted by law.
10. General Conditions. Sponsor reserves the right, subject to applicable law, to cancel, suspend, extend, or modify the Giveaway, or any portion of it, if fraud, technical failure, unauthorized intervention, human error, force majeure, or another cause beyond Sponsor’s reasonable control corrupts or impairs the administration, security, fairness, integrity, or proper operation of the Giveaway. If the Giveaway is terminated before the scheduled end of the Entry Period, Sponsor may select potential winners by random drawing from among the eligible, non-suspect entries received before the action requiring termination, if feasible and lawful. Sponsor’s failure to enforce any provision of these Official Rules does not constitute a waiver of that provision. If any provision of these Official Rules is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
11. Release and Limitation of Liability. To the fullest extent permitted by law, by entering, each entrant agrees to release, discharge, indemnify, and hold harmless Sponsor, its parents, subsidiaries, affiliates, advertising and promotion agencies, representatives, contractors, prize suppliers, and each of their respective officers, directors, members, managers, employees, agents, and representatives (collectively, the “Released Parties”) from claims, damages, losses, liabilities, costs, and expenses arising out of or relating to: (a) participation or attempted participation in the Giveaway; (b) acceptance, possession, use, misuse, loss, or inability to use a prize; (c) attendance at, travel to, or participation in a theatrical showing; (d) personal injury, death, or property damage; (e) publicity or privacy rights; (f) errors in administering the Giveaway; or (g) any technical, printing, typographical, human, or other error. The Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered, corrupted, or garbled entries or communications; interrupted or unavailable networks, servers, websites, internet connections, email systems, hardware, software, or devices; unauthorized human intervention; or incorrect capture or processing of entry information. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE RELEASED PARTIES’ TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE GIVEAWAY, THESE OFFICIAL RULES, OR ANY PRIZE, REGARDLESS OF THE FORM OR THEORY OF THE CLAIM, WILL NOT EXCEED THE STATED APPROXIMATE RETAIL VALUE OF THE PRIZE, WHICH IS FORTY DOLLARS ($40.00). TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE RELEASED PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF OPPORTUNITY, OR LOSS OF PROFITS, ARISING OUT OF OR RELATING TO THE GIVEAWAY OR ANY PRIZE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The limitations and exclusions in this Section do not apply to liability arising from a Released Party’s gross negligence, reckless conduct, willful or intentional misconduct, fraud, or any other liability that cannot lawfully be released, excluded, or limited. Nothing in these Official Rules waives or limits any non-waivable rights or remedies under applicable law.
12. Privacy. Sponsor will collect the entrant’s first name, email address, and ZIP Code to administer the Giveaway. Sponsor may collect additional information from potential winners, including full legal name, address, date of birth, telephone number, and proof of identity, age, or residence, for eligibility verification, prize fulfillment, recordkeeping, and legal compliance. Information collected in connection with the Giveaway will be handled in accordance with Sponsor’s Privacy Policy, available at https://sumerianpictures.com/privacy-policy/, and these Official Rules. Entry does not enroll an entrant in marketing communications. Sponsor may send marketing email only where the entrant separately and affirmatively elects to receive it. An entrant’s decision not to receive marketing communications will not affect the entrant’s eligibility or chances of winning.
13. Disputes and Governing Law. Except where prohibited, entrants agree that any dispute, claim, or cause of action arising out of or relating to the Giveaway or any prize will be resolved individually, without resort to any form of class action. All issues concerning the construction, validity, interpretation, and enforceability of these Official Rules and the rights and obligations of entrants and Sponsor will be governed by the laws of the State of Tennessee, without giving effect to choice-of-law or conflict-of-law principles that would result in the application of another jurisdiction’s laws. Subject to applicable law, exclusive jurisdiction and venue for any dispute will lie in the state or federal courts located in Davidson County, Tennessee, and each entrant consents to the personal jurisdiction of those courts. To the fullest extent permitted by law, recovery will be limited to actual out-of-pocket costs incurred in entering the Giveaway, and entrants waive any right to claim punitive, incidental, consequential, special, multiplied, or other indirect damages or attorneys’ fees.
14. Social Media and Promotional Platforms. The Giveaway may be advertised through Sponsor’s website, email newsletter, and unpaid social media posts. Entry is available only through the entry method described in Section 4. The Giveaway is not sponsored, endorsed, administered by, or associated with Meta, Facebook, Instagram, TikTok, YouTube, X, or any other social media or digital platform through which it may be promoted. By participating, each entrant releases those platforms from claims arising from or relating to the Giveaway to the extent permitted by law. Questions, comments, and complaints concerning the Giveaway must be directed to Sponsor and not to any social media platform.
15. Winner List. To request the first name, last initial, city, and state of the confirmed winner or winners, send an email to pictures@sumerian.com with the subject line “The Incomer Giveaway Winner List Request” within sixty (60) days after the end of the Entry Period. The winner list will be provided after the winners have been verified and the prizes have been awarded, subject to applicable law.
